 Terms and Conditions.

Driving Instructor

The following terms and conditions represent the basis upon which my training is offered.

The provision of training is subject to the acceptance of these terms and conditions.

Driving license & fitness to drive:

​

You must be of legal age to drive and hold a valid UK/Northern Ireland provisional Category B driving licence. In Great Britain, the photo card and permission code to verify the licence online must be produced.  If an older style paper licence is held, then you must also produce a valid passport as photographic identification. For Motorway, Pass Plus or refresher lessons a full valid licence must be produced, with identification if necessary, as above. All drivers must meet the minimum eye test requirements, which means you must be able to read a standard UK approved number plate at a minimum distance of 20.5 metres (67 feet).  If you need to wear glasses or contact lenses in order to meet this requirement then by law you must wear them whenever you drive. You must not be under the influence of drugs or alcohol during your lessons. In the event of there being any signs of drugs/alcohol use, your instructor will refuse use of the tuition car  until you are in a legal and fit state to drive. Any prescribed medication that may effect your driving should be declared to the instructor and to the DVLA medical board. If you turn up for a lesson whilst under the influence, the lesson will be refused and you will forfeit the lessons cost.

Bookings and payments:

​

A single lesson is 2 hours in length. To guarantee a diary slot, payment must be made in full, by bank transfer 7 days in advance of a lesson. Any advertised discounts are based on the currently advertised single lesson price. All offers and prices are subject to review. Quoted prices are for weekday, day time (9am-5pm) driving lessons in Bolton, booked & paid for in advance unless agreed otherwise with me. As your instructor, I will endeavour to maintain regular lesson slots each week to ensure continuity of learning, however this cannot be guaranteed. Only booked and paid for lessons will be guaranteed in my diary.

If for any reason, I am late for a lesson I will make a concerted effort to inform you of the estimated time of arrival. If it's possible the current lesson will be extended so that you still get your full lesson time. However any time owed can if required be carried forward to the next suitable lesson. I will always endeavour to arrive on time, however due to unforeseen circumstances such as breakdown, accidents, and traffic hold ups etc, lesson times may need to change or even be cancelled. If cancelled by me, you will not be charged. However if I arrive on time at a pre-arranged pick up point for a pre booked lesson, and you do not show up, I will wait 10 minutes and try to contact you by phone or text, to find out what the problem is. If it's not possible to contact you, after 10 minutes I will leave, and the lesson time remains chargeable.

​All block booked lessons paid for in advance ( to take advantage of cheaper prices) must be taken within a maximum of 3 months from the date of payment. After 3 months no refunds will be given. If lessons have been taken at block booking prices, and you decide not to continue lessons, any refunds due within the 3 month period will be calculated as if all previous lessons were provided at the currently advertised single lesson price at the time of the refund.

Cancellations:

Should you need to cancel or re-arrange a driving lesson, you are required to give your me a minimum of at least 48 hours notice for single lessons of two hours in duration. I may allow a 24-hour cancellation period at my discretion for a genuine and legitimate reason, dependant on circumstances. (i.e.hospital admittance, doctors note). Failure to give sufficient notice will result in your having to pay the full value of the lesson cancelled in compensation for my time. Should you need to cancel at any time you must telephone me to do so, leaving a voice message if necessary.

 

As your instructor, I do everything possible to ensure that a lesson starts and finishes on time, but I reserve the right to cancel, postpone, or change lesson lengths and start or finish times under certain circumstances (e.g., dangerous weather conditions, pupil tests, family responsibilities etc). In the event of postponement, fees paid in advance will be carried forward. However I reserve the right to cancel a lesson at short notice if I suspect that a pupil may be unfit to continue to drive due to the effects of alcohol or drugs (prescribed or otherwise), or any other condition that would cause his/her driving to be dangerous or illegal. In such circumstances the lesson fee will be payable.

Training Location:

All driving lessons will start and finish at the same location unless alternative arrangements are made with me in advance. I will determine a practical location for each lesson which ensures both pupil and public safety, this means that the I may need to drive you to and from a location. This journey time forms part of the lesson.

 

Training Vehicle:

Training vehicles used by me are taxed and insured for the purposes of driving tuition, fully roadworthy and fitted with dual controls. Qualified trainees who require tuition in their own vehicle must supply evidence from their motor insurer that the car is covered for lessons when being supervised by a professional instructor in return for payment; the car must also be taxed and hold a current MOT certificate where appropriate.

 

Fines and Penalty Points:

All lessons comply with the Highway Code and UK Law. Therefore if you whilst under tuition exceed the speed limit or break any driving laws, you will be responsible for any fines or penalty points incurred. Each of your lessons is recorded and I may if necessary use the recording as evidence in the event of an accident

 

Driving tests bookings:

Where my car is required for a driving test, the booking will need to fit into my normal diary schedule, and this should be agreed with me before confirming the test booking. We will discuss with your test readiness and come to an agreement with you about when to book your test. We will agree upon lessons necessary to ensure you get to a standard that will enable you to pass the DVSA test and be ready for driving safely without supervision. If you miss any of lessons, or I feel that you have not reached test standard, I reserve the right to reschedule your test, or to withhold the use of my driving school car for the test. I will not do so without giving you prior notice. You may book your own test, with my permission and on agreeing suitable dates and times. Depending on the location and time of the test this will require a minimum three-hour booking and possibly longer.

 

I reserve the right to refuse the use of my vehicle for test purposes if I deem that provision of the vehicle could cause a risk to public safety. The fee for the test day will be agreed in advance with your instructor. I will make every effort to ensure that the vehicle supplied for test will be fully road worthy and comply with all legal requirements at the start of the test, I cannot be held responsible for vehicle failure that occurs during the test and I am therefore not liable for any consequential loss. I cannot be held responsible for test appointments cancelled by the DVSA due to bad weather, sickness, staff shortages, or other reasons. Such cancellations are beyond my control and therefore the lesson fee and 'use of car' fee for the booked period will be charged. Your instructor will advise about claiming compensation from the DVSA for a test cancelled by them

 

Code of conduct:

I agree to abide by the conditions of the DVSA Professional Code of Conduct. In the unlikely event of complaint or dispute the guidelines of the Code of Conduct will be adhered to.

 

Your rights:

These conditions do not affect any protection a student has under consumer legislation. I reserve the right to change or alter any of the terms and conditions without notice, but will endeavour to inform pupils of any changes as soon as possible.
